Terms & Conditions

Welcome to FloridaStormwater.com (“Site”), operated by Cheryl L. Moore Consulting, LLC (“Company,” “we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site, our training services (including in‑person and virtual classes), course materials, registrations, payments, and any related offerings (collectively, the “Services”).

By accessing the Site or registering for a class, you agree to these Terms and to our /privacy. If you do not agree, do not use the Site or Services.

1) Eligibility & Account

  •  You must be at least 18 years old (or the age of legal majority in your      jurisdiction) to register for training.
  • You agree to provide accurate, complete information during registration      and to keep it current.
  • You are responsible for all activity under your account and for safeguarding your login credentials.

2) Training Offerings & Program Relationships

  •   We provide training programs including (but not limited to) FSESCI (Tier I & II), MS4 (Level I & II), and Advanced/Specialty Courses.
  • We are a training provider, not a regulatory agency or licensor. Program      requirements, certification standards, and verification processes may be governed by third parties and are subject to change outside our control.
  • Successful completion of a course does not guarantee certification, licensure,  job placement, or compliance with any specific permit requirements. You are responsible for verifying current regulatory requirements relevant to your role or organization.

3) Registration, Pricing & Payment

  •  Class availability, formats (in‑person/virtual), locations, schedules, and      instructors are listed on the Training Calendar and may change.
  • Prices  are shown at checkout and are subject to change until payment is completed.
  • Payment is due at the time of registration unless otherwise arranged in writing.
  • We may use third‑party processors for payments and registrations. By purchasing, you agree to their terms and any applicable fees. We do not store full credit card details on our systems.

4) Cancellations, Rescheduling, Substitutions & No Shows

  • Participant Cancellations: 

  1. ≥ 14 days before the class: full refund or credit (minus any non‑refundable processing fees).
  2. 13–7 days before the class: 50% refund or full credit.
  3. < 7 days before the class: no refund; credit may be offered at our discretion.

  • Substitutions: You may substitute an attendee once at no charge up to 24 hours before the class; additional substitutions may incur a fee.
  • Rescheduling by Participant: One complimentary reschedule per registration if requested ≥ 7 days before the class; additional reschedules or later requests may incur a fee.
  • No‑Shows: If you do not attend and did not cancel per the above timelines, the registration fee is forfeited.
  • Company Cancellations/Changes: We may cancel, reschedule, or convert to virtual due to low enrollment, venue issues, instructor illness, severe weather, emergencies, or events beyond our control. You will be offered (a) a transfer to a future class, or (b) a full refund of the base registration price. We are not responsible for travel or incidental costs.

5) Attendance, Conduct & Technology (for Virtual Classes)

  •   Attendance: You must attend the required instructional hours to receive completion credit. Late arrivals or early departures may result in non‑completion.
  • Professional Conduct: We maintain a safe, respectful learning environment. We may remove any participant for disruptive, abusive, or unsafe behavior without refund.
  • Technology Requirements (Virtual): A stable internet connection, a device with  camera/mic (if required), and an appropriate environment for      learning/testing. If you cannot participate due to technology failure on      your end, it may be treated as a no‑show.
  • Recording & Screenshots: Unless expressly permitted by us in writing,      recording, copying, or distributing any portion of the class is prohibited. We may record classes for administrative or quality purposes; see the Privacy Policy for details.

6) Exams, Certificates & Continuing Education

  •   Exam Administration: Certain courses may include a proctored exam with specific rules. Cheating or violating exam integrity protocols may result in disqualification without refund.
  • Certificates/CEUs: Issuance depends on attendance, completion, exam results (if applicable), and any partner rules. Processing times may vary.
  • Third‑Party Verification: Where certificate verification is provided by a partner or program administrator, their systems and policies apply. We do not guarantee the availability or accuracy of third‑party verification tools.

7) Training Materials & Intellectual Property

  •   All content, slides, manuals, handouts, videos, and assessments provided by us (or our licensors) are protected by copyright and other intellectual property laws.
  • We grant you a limited, non‑exclusive, non‑transferable license to use      course materials solely for your personal professional development.
  • You may not copy, reproduce, distribute, post online, resell, or create      derivative works from any materials without our prior written consent.

8) Use of the Site

  •   You agree not to: 
    • Interfere with, damage, or disrupt the Site or Services;
    • Use any manual or automated means to scrape data or circumvent security;
    • Misrepresent your identity or affiliation;
    • Upload or transmit malware or harmful code.
  • We may restrict or terminate access for any violation of these Terms.

9) Third Party Services & Links

Our Services may rely on or link to third‑party platforms (e.g., registration/payment processors, video platforms, certificate portals). We are not responsible for third‑party content, policies, or availability. Your use of those services is governed by their terms and privacy policies.

10) Privacy

Your use of the Site and Services is also governed by our /privacy, which explains what data we collect, how we use it, and your choices.

11) Accessibility & Accommodations

We strive to make our classes and materials accessible. If you require reasonable accommodations (in‑person or virtual), please contact us at jessica@floridastormwater.com at least 7 days before your class so we can discuss available options.

12) Disclaimers

  •   The Site and Services are provided on an “as is” and “as available” basis.
  • We make no warranties of any kind, express or implied, including      warranties of merchantability, fitness for a particular purpose, title, or non‑infringement.
  • We do not warrant that the Services will be uninterrupted, timely, secure, error‑free, or that defects will be corrected.

13) Limitation of Liability

  To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential,      exemplary, or punitive damages, including lost profits, lost data, or      business interruption, arising from or related to the Site or Services.
  • Our  total aggregate liability for any claims arising from or relating to the Services shall not exceed the amount you paid to us for the specific class or service giving rise to the claim.
  • Some jurisdictions do not allow certain exclusions or limitations; in those      cases, our liability will be limited to the fullest extent permitted by law.

14) Indemnification

You agree to defend, indemnify, and hold harmless the Company, its owners, employees, instructors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your: (a) use of the Site or Services; (b) violation of these Terms; (c) infringement or violation of any third‑party rights.

15) Force Majeure

We are not responsible for delays or failure to perform due to causes beyond our reasonable control, including acts of God, extreme weather, public health emergencies, war, labor disputes, government actions, utility failures, or network outages.

16) Changes to Classes, Site, or Terms

We may make changes to class content, schedules, instructors, pricing, or formats at any time.
We may update these Terms from time to time. Material changes will be posted with an updated “Last Updated” date. Your continued use after changes means you accept the updated Terms.

17) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida.
Any dispute, claim, or legal action arising out of or relating to the Site or Services must be brought exclusively in the state or federal courts located in Hillsborough County, Florida.
By using our Services, you agree to submit to the personal jurisdiction of these courts.

18) Severability & Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of future enforcement.

19) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.
